  • Non-resident applicants (excluding those applying through the Madrid Protocol) must be represented by a TurkPatent-authorized trademark attorney.
  • The registration process follows the Industrial Property Code No. 6769. – The Nice Classification is adopted for categorizing goods and services.
  • Turkey is a member of World Intellectual Property Organization (WIPO), Paris Convention and World Trade Organization (WTO)
  • Priority can be claimed under the Paris Convention.

  4. Latin transliteration of trademark representation if any letters or words are used other than Latin alphabet
  5. Information about letter of consent, if any*
  6. Information about priority (date, number, country of origin), if any**

* The letter of consent should be notarized and legalized.

** Priority document with its sworn translation into Turkish can be filed either at the time of application or within 3 months as of the application.

  • Ex-officio Examination (1-6 months): TurkPatent examines the application for prior similar trademarks and potential grounds for refusal.
  • Publication (2 months): Once accepted, the trademark is published in the official bulletin.
  • Opposition and Appeals: If an opposition is filed against a trademark application or a refusal is issued, the applicant has the right to appeal the decision.
  • Granting Registration (2 months): If no opposition is filed, or the opposition is rejected, the trademark registration certificate is issued.
  • Letter of Consent: If the trademark is at risk of refusal due to prior similar trademarks, the applicant can submit a notarized Letter of Consent (LoC) from the prior trademark owner. This can be done either during the application process or before the decision on the appeal to overcome the refusal and allow the application to proceed to publication.
  • Trademark Protection and Renewal:

A registered trademark is protected for ten years from the filing date, with the option to renew for additional ten-year periods. To avoid any lapses, trademark renewal requests should be made six months before the expiration date. If the renewal deadline is missed, a late renewal request can be submitted within six months after the expiration, subject to an additional fee.
