General Information
- Oppositions are filed to the Turkish Patent and Trademark Office.
- Nonresident applicants must be represented by an authorized local trademark attorney.

- Grounds for opposition: Likelihood of confusion; Similarity; Well-known mark; Bad faith, etc.
- Evidence and supporting documents to substantiate the opposition: Trademark registration; Commercial use evidence; Reputation evidence; Bad faith evidence; Translations of the related documents.
Prodecure & Timeline
- The deadline to file an opposition against a trademark is 2 months from the publication date in the bulletin.
- The deadline to file a counterview against an opposition is 1 month from the date of the notification.
- Proof of use can be requested for trademarks that have been registered for more than 5 years starting from the opponent’s trademark application/priority date.
- After the oppositions and counterviews are submitted by both parties, the officer reviews the file and makes a decision.
- To appeal the decision, a two-month period is provided from the date of notification.
- The second appeal is reviewed again by the Re-Examination and Evaluation Board.
- Board decisions are final, and no further objections can be made to the TurkPatent.
- The decision of the Re-Examination and Evaluation Board can only be appealed in court.
